
The Harrogate District Local Plan 2014 – 2035 was adopted by Harrogate Borough Council on the 4th March 2020. The Plan sets out the broad spatial planning policy framework and vision for Harrogate District as well as the necessary allocations and infrastructure to support this growth. The Plan will be used to make decisions on future planning applications.
The Harrogate District Local Plan was submitted to the Planning Inspectorate for Examination on 31st August 2018. This examination commenced on 15th January 2019 and ran until 15th February 2019. The Inspectors’ Report concluded that, with the recommended main modifications which are set out in his report, that the Harrogate District Local Plan satisfies the requirements of Section 20(5) of the Planning and Compulsory Purchase Act 2004 (as amended) and meets the criteria for soundness in the National Planning Policy Framework.
In accordance with regulations 26 and 35 of theTown and Country Planning (Local Planning)(England) Regulations 2012 (as amended), the Adopted Harrogate District Local Plan, Adoption Statement and Sustainability Appraisal (SA) Report have been published alongside the Sustainability Appraisal Post-Adoption Statement in accordance with regulation 16 of the Environmental Assessment of Plans and Programmes Regulations 2004. Any person aggrieved by the Harrogate District Local Plan (2014-2035) may, with the leave of the High Court, make an application to the High Court under section 113(3) of the Planning and Compulsory Purchase Act 2004 (as amended) on the grounds that: (a) the document is not within the appropriate power (as defined in section 113(9) of the Planning and Compulsory Purchase Act 2004); or (b) a procedural requirement has not been complied with.
Any such application must be made to the High Court not later than the 16th April 2020 (this represents a period of six weeks for applications beginning with the day after the date on which the Local Plan was adopted). A copy of this Adoption Statement will be sent to the Secretary of State for Housing, Communities and Local Government.
